A true story about corrupt politics, government, law and media and
their cover-up of fraud. 

This site reports the despicable actions of former New South Wales Ministers. Bruce Baird the father of former Premier Mike Baird and Bob Carr were among them. They destroyed a small family business which produced the two houseboats pictured above. In recent years it has emerged that their officials were involved on a much more personal level.

By tying the matter up in the Family Court for five years they managed to cover up their departments gross maladministration of a commercial marine application.

Even today the anti-corruption commissions in both New South Wales and Victoria have chosen to cover-up rather than prosecute.

Bob Carr rose to be NSW Premier and then a former Australian Foreign Minister.

Earlier however, he was also NSW Minister for Planning and Environment in 1987.

He signed the Murray Regional Environment Plan #1 in September.

He wrote about the approval process for a botel development.

It is highly likely he worked with those listed to hinder that process.

Eventually in 1988 the maritime Regional Manager broke ranks and approved the project.

In doing so he exposed the maladministration of the previous two years.

Bruce Baird stepped in and cancelled the mooring licence and together with local council officials; confiscated and destroyed the houseboats in 1990.

That required the support of crooked sections of the media and law.

Five years ago (2012) a firm of town planners from WA published some information online which exposed and linked parties in Swan Hill to these matters.

Their personal attacks led the wife to abandon the family business aided by her Family Court solicitors.

She passed in 1995 at age 30.

So here is the story of how Swan Hill in Victoria got its pokie club over the river.

BACKGROUND


 


Waterhouse Enterprises was established in 1986. The small family business would build and sell houseboats on the Murray River. This was nothing new. There are many of them on the Murray.  It soon becomes apparent that there is some resistance and confusion about the maritime venture. Living aboard permanently is the problem.


Your research into the delay reveals a great opportunity to rent these vessels (houseboats) for short stays. Some river towns on the NSW side of the Murray River are booming with busloads of interstate visitors. They are drawn to the the pokies which are not legal in Victoria. In Barham (and other places) there is a shortage of beds to cater for them. Because of this the majority stay a few hours before departing again. The pokie venue benefits but not the other town businesses. 


You write many letters  Is it a boat or a marina or a motel ? It floats. It has no foundations. It moves about. To you it is obvious - it is a botel. It has no precedence; hence there is no law preventing it.


Further research reveals a solution to another problem; that of pollution in the Murray River. While SA has dozens of pumpout stations to service vessels NSW has only two located at Wentworth and Echuca. You learn that there are thirteen unsewered river towns and those that are sewered return their outfall to the River. 


You reveal your plans for a unique and unprecedented chain of Botel Marinas. Each will use the domes as service vessels (office and restaurant) and the small houseboats can attach together forming a floating platform. Each part can be moved along the river to other sites as needed. Each botel provides a pumpout for any vessel wishing to use it free of charge.


Initially, you have widespread political, council and local support. You order $30K in prefabricated components. You think you will have saleable houseboats if the botel plan fails.


But where is your mooring licence from Maritime? Terry Mecham from Crown Lands Office in Hay tells you that a licence can be terminated 'at will' by a minister. He insists that a 'special lease' from Crown Lands would be better. It has been a year since you applied for these agreements. Your steel sections are rusting and your plywood panels are showing signs of deterioration. You read the local rag and come to realise that the local council are just a front for higher powers.  


A year has gone by without resolution of the formal applications. You go ahead and build the small houseboat. Council had agreed in principle to the botel but now threatens legal action. It is a bluff so you threaten Maritime and they soon issue the mooring licence. Not long after Regional Television TV8 (right) airs a report about a 'Botel Battle'. It contained serious factual errors and in 2012 you would discover those behind the report. 


You know that you have upset a lot of people in Sydney. Bob Carr is the State Planning Minister and you believe he is behind the delays. Planning officials are running the show. But it is the IRRIGATORS of the Murray Darling Basin who have the power. This becomes evident when the the local member plainly announces it in the NSW house of Parliament. 


A dozen authorities in 2 states have bullied you with a mountain of red-tape. You have complied with each requirement knowing that they would eventually hang themselves. By February of 1988 they do just that. Council claimed they were consent authority. They write to the Planning Minister to take authority over their role because it is a statewide project which extends beyond local government. 


You realise that politics, law and the media have all conspired to destroy you. You make a stand and test them once again. You build the large floating boathouse during the 1988 winter. NSW Parliament discuss the project. Their accounts are not true


Meanwhile council have created a FAKE entry (13/88) in their Development Application Register. They refuse the application and you instruct your solicitors to lodge an appeal in the NSW Land and Environment Court. You believe they have done so however when the appeal does not proceed you realize your solicitors have screwed you as well. 


Your documents show deliberate gross maladministration. Officials need to cover their tracks and so they destroy and confiscate your vessels. The property is held by Wakool Shire Council.  


Your family has suffered greatly throughout this four year period. 25 years pass and in 2012 you stumble upon a town planning website. Smithson Planning claim that they advised the council about your application. However, they falsely report the location as being on the Edwards River near the town of Wakool. You now know it is related to the fake council application. You realise you have met these people long ago in Swan Hill under the pretext that they wanted to finance your project. They introduced themselves as the Swan Hill Promotion Group. Much later you realise that you have known one (Solicitor - Chris Mahon) of those present from your schooldays and also from the court at Swan Hill.


You have hundreds of documents. Since 2012 NSW authorities have said that they have "no information" and "files have been destroyed". You believe they are lying because of this email.  To you it appears that the gentleman is referring to a file. You can see that the dates mentioned (circa1985-1988) are incorrect.  





In 2012 it emerged that the Shire Council was being secretly guided the Swan Hill Promotion Group and Smithson Planning.   Today, Council say that there is no record of a Boatel on the Edward River as described by Smithson.  


The following two documents are about the same vessels (pictured above). NSW Maritime Regional Manager Captain John Hensford signed both documents however NSW Maritime claim that they have no record of them. (see current GIPA) There can be no doubt that Hensford broke ranks in 1988 and gave approval for the commercial marine venture. He wrote that it was not a botel. 


He was demoted and then issued a formal Notice in which he wrote the vessels were part of a botel. He confiscated them because the licence was cancelled. Only Minister Bruce Baird had the power to do so however in this recent SMS he denies knowledge of it.

It is hard to say who used who. Was it a small group of people (Barham Progress Association) with powerful connections in politics, law and media or Bob Carr and other NSW ministers with the same connections who destroyed the project ?  


Either way, they were able to use the regional media and Parliament to create a false sense of widespread opposition.  Here is a real petition which supported the botel marina.
